These Terms and Conditions of Enrolment ("Terms") form a legally binding agreement between Young Actors Academy and the Parent/Guardian responsible for the Student. They govern the provision of all Services supplied by Young Actors Academy.

These Terms and Conditions ("Terms") govern the provision of all services supplied by Young Actors Academy ("Young Actors Academy", "YAA", "we", "our" or "us").
By enrolling a Student with Young Actors Academy, the Parent/Guardian confirms that they have read, understood and agree to be bound by these Terms.
These Terms apply to all services provided by Young Actors Academy unless otherwise stated in writing, including but not limited to:
Details of our policies, including our Privacy Policy, Safeguarding & Child Protection Policy and Complaints Policy, are available on request or via our website where applicable.
For the purposes of these Terms, the following definitions apply:
Academy, Young Actors Academy, we, our or us means Young Actors Academy.
Parent/Guardian means the parent, legal guardian or any person who enters into this agreement on behalf of a Student. Where a Student is aged 18 years or over, references to the Parent/Guardian shall also include the Student where appropriate.
Student means the individual enrolled in any Service provided by Young Actors Academy.
Service means any class, lesson, tuition, workshop, holiday activity, rehearsal, production, performance, examination preparation, online lesson, event or any other activity delivered by Young Actors Academy.
Subscription means the recurring monthly payment that reserves a Student's place within an ongoing Service until cancelled in accordance with these Terms.
Fees means all sums payable to Young Actors Academy, including Subscription fees, examination fees, workshop fees, event fees, administration charges and any other agreed charges.
Written Notice means notice sent by email to the official Young Actors Academy email address published on our website.
Working Day means Monday to Friday excluding public holidays in England and Wales.
Notice Period means the required thirty (30) calendar days' Written Notice required to end a Subscription.
2.1 A Student's place is confirmed only when:
a) the required registration process has been completed;
b) all requested information has been supplied;
c) a valid payment method has been established; and
d) Young Actors Academy has accepted the enrolment.
2.2 Young Actors Academy reserves the right to refuse or decline an enrolment where it reasonably considers this to be in the best interests of the Student, other Students, staff or the Academy.
2.3 Parents and Guardians are responsible for ensuring that all enrolment information remains accurate and must notify Young Actors Academy promptly of any changes to contact details, medical information, emergency contacts or any other information relevant to the Student.
3.1 Young Actors Academy operates a rolling monthly Subscription model for its ongoing Services.
3.2 A Subscription reserves the Student's place within the relevant Service and guarantees that place until the Subscription ends in accordance with these Terms.
3.3 Subscription payments are for the reservation of the Student's place and are not calculated according to the number of individual sessions attended.
3.4 Subscription fees enable Young Actors Academy to maintain:
3.5 Subscription payments are normally collected automatically through Stripe, or such other payment provider as Young Actors Academy may use from time to time, using the payment method authorised by the Parent/Guardian.
3.6 The first payment will normally be collected at the time of enrolment unless otherwise agreed in writing.
3.7 Future Subscription payments will normally be collected monthly on the same calendar date.
3.8 Parents and Guardians remain responsible for ensuring that valid payment details are maintained throughout the Subscription.
3.9 Young Actors Academy reserves the right to amend Subscription fees. Where fees increase, reasonable written notice will be provided before the increase takes effect.
4.1 If a Subscription payment cannot be collected, Young Actors Academy will attempt to recover the payment using Stripe's automated payment recovery process where applicable.
4.2 Parents and Guardians remain responsible for ensuring that payment is successfully made, regardless of any automated payment retry process.
4.3 If payment remains outstanding, Young Actors Academy will notify the Parent/Guardian.
4.4 Payment must be resolved within seven (7) calendar days of the original payment due date.
4.5 If payment has not been received within seven (7) calendar days, Young Actors Academy reserves the right to apply a £15 late payment administration fee.
4.6 If payment remains outstanding after fourteen (14) calendar days, Young Actors Academy may suspend the Student from attending any Service until all outstanding amounts have been paid.
4.7 If payment remains outstanding after thirty (30) calendar days, Young Actors Academy reserves the right to recover the outstanding balance through any lawful means available, including:
a) instructing a debt recovery agency; and/or
b) issuing proceedings through the County Court.
4.8 The Parent/Guardian shall remain responsible for all outstanding Fees together with any reasonable costs of recovery that are legally recoverable.
4.9 Any suspension under this clause does not end the Subscription and Subscription Fees shall continue to be payable until the agreement is brought to an end in accordance with Clause 5.
5.1 The Subscription shall continue until ended in accordance with this clause.
5.2 The Parent/Guardian may end the Subscription by giving Young Actors Academy not less than thirty (30) calendar days' Written Notice.
5.3 Subscription payments remain payable throughout the Notice Period.
5.4 Failure to attend a Service does not end the Subscription.
5.5 Stopping or attempting to stop a payment, cancelling a payment card, disputing a payment or otherwise preventing payment collection does not constitute notice of cancellation and does not remove the obligation to pay Subscription Fees due under these Terms.
5.6 Young Actors Academy reserves the right to continue collecting Subscription Fees due during the Notice Period.
5.7 Young Actors Academy may terminate a Student's enrolment immediately where there has been a serious breach of these Terms, including but not limited to serious misconduct, abusive behaviour, safeguarding concerns or persistent non-payment.
6.1 Young Actors Academy operates on a Subscription basis. Subscription Fees reserve the Student's place within the relevant Service and are not calculated according to attendance at individual sessions.
6.2 As a place is reserved exclusively for each Student, Subscription Fees remain payable whether or not the Student attends individual sessions.
6.3 No refund, credit or reduction in Subscription Fees will be given where a Student is unable to attend due to, including but not limited to:
a) illness;
b) injury;
c) holidays;
d) school trips or educational visits;
e) family commitments;
f) examinations;
g) transport difficulties; or
h) any other personal circumstance.
6.4 Missed sessions cannot normally be carried forward or exchanged.
6.5 Young Actors Academy may, entirely at its discretion, offer an alternative session where reasonably practicable. Any alternative session is offered as a gesture of goodwill and does not create an entitlement to future replacement sessions.
6.6 Where Young Actors Academy cancels a session and is unable to provide a suitable alternative, an appropriate replacement session, extension or credit may be offered at our discretion.
7.1 Regular attendance is encouraged to support each Student's development and the progress of the wider group.
7.2 Parents and Guardians should notify Young Actors Academy as soon as reasonably possible if a Student will be absent.
7.3 Students should arrive promptly for the start of each Service and be collected promptly at the published finishing time.
7.4 Young Actors Academy is not responsible for teaching or rehearsing material missed due to late arrival or absence.
7.5 Repeated lateness or poor attendance may affect casting decisions, examination readiness and participation in performances or other opportunities.
8.1 Young Actors Academy is committed to providing a safe, inclusive and positive learning environment for all Students.
8.2 Students are expected to:
a) treat staff, volunteers and fellow Students with respect;
b) follow reasonable instructions given by members of staff;
c) behave in a manner that does not disrupt the learning of others;
d) take reasonable care of Academy property, equipment and venues.
8.3 Parents, Guardians and family members are expected to behave respectfully towards Young Actors Academy staff, volunteers, Students and other families at all times, including in person, by telephone, by email, through messaging services and on social media.
8.4 Young Actors Academy will not tolerate behaviour including, but not limited to:
a) bullying;
b) harassment;
c) discrimination;
d) abusive, threatening or intimidating behaviour;
e) deliberate damage to property;
f) behaviour that places others at risk.
8.5 Young Actors Academy reserves the right to suspend or terminate a Student's enrolment where, in the reasonable opinion of Young Actors Academy, behaviour is unacceptable or continued participation is not in the best interests of the Academy, its staff or other Students.
8.6 Where enrolment is terminated under this clause, Subscription Fees remain payable in accordance with the Notice Period unless Young Actors Academy determines otherwise.
9.1 The welfare of every Student is Young Actors Academy's highest priority.
9.2 Young Actors Academy maintains safeguarding policies and procedures designed to promote the safety and wellbeing of all Students.
9.3 All members of staff and volunteers working with children are recruited and vetted in accordance with applicable safeguarding requirements.
9.4 Any safeguarding concern will be managed in accordance with Young Actors Academy's Safeguarding and Child Protection Policy and, where appropriate, may be referred to the relevant statutory authorities.
9.5 Parents and Guardians agree to support Young Actors Academy in promoting a safe environment for all Students.
10.1 Parents and Guardians must provide accurate and complete information regarding any medical conditions, allergies, disabilities, additional needs or emergency contact details relevant to the Student.
10.2 Parents and Guardians must notify Young Actors Academy promptly of any changes to this information.
10.3 Parents and Guardians must not allow a Student to attend a Service if they are suffering from an illness or medical condition that could present a risk to themselves or others.
10.4 Young Actors Academy will take reasonable steps to accommodate individual needs where practicable but cannot guarantee that every requirement can be met in every venue or activity.
10.5 In the event of illness, accident or emergency, Young Actors Academy may seek appropriate medical assistance where it reasonably considers this necessary.
10.6 Any costs associated with medical treatment remain the responsibility of the Parent/Guardian.
11.1 Responsibility for the Student remains with the Parent/Guardian until the Student has been safely handed over to a member of Young Actors Academy staff at the start of the Service.
11.2 Responsibility for the Student returns to the Parent/Guardian immediately at the published finish time of the Service.
11.3 Parents and Guardians must ensure that Students are dropped off no earlier than the time advised by Young Actors Academy unless prior arrangements have been made.
11.4 Students must be collected promptly at the published finish time. If a Parent/Guardian anticipates being late, they should notify Young Actors Academy as soon as reasonably practicable.
11.5 Where Young Actors Academy incurs additional staffing or venue costs due to persistent late collection, we reserve the right to charge a reasonable late collection charge to cover any additional staffing or venue costs incurred.
11.6 If a Student has not been collected within a reasonable period and we are unable to contact the Parent/Guardian or any emergency contact, Young Actors Academy reserves the right to contact the appropriate authorities where this is considered necessary to safeguard the Student.
11.7 Young Actors Academy is not responsible for supervising Students outside the advertised session times, except where this is necessary due to an emergency or safeguarding concern.
12.1 Young Actors Academy may take photographs and video recordings during classes, rehearsals, performances, examinations, workshops and events for promotional, educational and archival purposes.
12.2 Consent for the use of photographs and video recordings is requested during the enrolment process.
12.3 Parents/Guardians may withdraw or amend their consent at any time by providing Written Notice. Withdrawal of consent will apply to future use only and will not require Young Actors Academy to remove or recall material that has already been lawfully published or distributed.
12.4 Young Actors Academy will make reasonable efforts to ensure that photographs and video recordings are used appropriately and respectfully.
13.1 Parents and Guardians are responsible for ensuring that Young Actors Academy always has a current email address, telephone number and emergency contact details.
13.2 Young Actors Academy will normally communicate important information, including notices relating to classes, fees, events, policy updates and these Terms and Conditions, by email. We may also use text message, telephone or other electronic communication where appropriate.
13.3 Parents and Guardians should regularly check the email account used during enrolment for communications from Young Actors Academy.
14.1 Young Actors Academy continually reviews its Services to ensure the highest possible standard of tuition.
14.2 We reserve the right to make reasonable changes to any Service, including but not limited to:
a) class content;
b) teaching methods;
c) timetables;
d) venues;
e) teachers;
f) class sizes;
g) age groups;
h) performance opportunities;
i) examination preparation; and
j) any other aspect of the Services.
14.3 Where reasonably practicable, Parents/Guardians will be given advance notice of significant changes.
14.4 Such changes shall not constitute grounds for immediate cancellation or refund.
15.1 Where Young Actors Academy provides tuition online, Students are expected to participate in an appropriate environment that is safe, quiet and free from unnecessary distractions.
15.2 Parents/Guardians remain responsible for ensuring that appropriate supervision is provided where required, taking into account the Student's age and needs.
15.3 Young Actors Academy is not responsible for interruptions caused by internet connectivity, equipment failure or technical issues beyond our reasonable control.
15.4 Online lessons must not be recorded by Students or Parents/Guardians without the prior written permission of Young Actors Academy.
16.1 Participation in LAMDA tuition does not guarantee entry to a LAMDA examination.
16.2 Examination entry is at the sole discretion of Young Actors Academy, taking into account the Student's readiness, preparation and likelihood of achieving an appropriate examination standard.
16.3 Examination fees are separate from Subscription Fees and must be paid by the published deadline.
16.4 Where examination fees are not received by the stated deadline, Young Actors Academy reserves the right not to submit the examination entry.
16.5 Once an examination entry has been submitted to LAMDA, examination fees are non-refundable except where a refund is permitted under LAMDA's own policies.
16.6 Young Actors Academy cannot guarantee examination dates, times or venues, as these are determined by LAMDA.
16.7 LAMDA in Schools Programmes
Where LAMDA tuition is provided as part of an in-school programme, the programme may have a fixed number of lessons, a total programme fee and a specified instalment schedule. These details will be stated at enrolment and shall apply in place of the general rolling monthly payment arrangements in Clause 3 where applicable.
Unless otherwise stated at enrolment, the cancellation provisions in Clause 5 continue to apply.
17.1 Workshops, holiday activities, masterclasses, productions, performances and other special events may be subject to separate booking arrangements and fees.
17.2 Unless otherwise stated at the time of booking, fees paid for these activities are non-refundable.
17.3 Young Actors Academy reserves the right to amend event schedules, venues or staffing where reasonably necessary.
17.4 If Young Actors Academy is required to cancel an event and cannot offer a suitable alternative, an appropriate refund or credit will be provided.
18.1 From time to time, Young Actors Academy may offer Students opportunities to participate in performances, productions, showcases, festivals or competitions.
18.2 Casting decisions are made solely by Young Actors Academy and are based on the artistic and educational needs of the production. Casting decisions are final.
18.3 Participation in productions, performances or examinations may be subject to satisfactory attendance, behaviour, commitment and preparation.
18.4 Young Actors Academy reserves the right to withdraw a Student from a production, performance or examination where it reasonably considers this to be in the best interests of the Student, the production or the wider Academy.
19.1 Students bring personal belongings to Young Actors Academy entirely at their own risk.
19.2 Young Actors Academy accepts no responsibility for the loss, theft or damage of personal belongings unless caused by our negligence.
19.3 Parents and Guardians are encouraged to ensure that valuable items are not brought to classes or events unless necessary.
20.1 Students must follow all reasonable health and safety instructions given by Young Actors Academy staff, venue staff or authorised representatives.
20.2 Young Actors Academy reserves the right to remove any Student from an activity where it reasonably believes that continued participation would present a risk to the Student or to others.
20.3 Parents and Guardians are responsible for ensuring that Students wear suitable clothing and footwear for the activities being undertaken and, where applicable, the required Young Actors Academy uniform.
21.1 All lesson plans, teaching materials, scripts, resources, branding, logos, photographs, videos, documents and other content created or supplied by Young Actors Academy remain the intellectual property of Young Actors Academy unless otherwise stated.
21.2 These materials are provided for the personal educational use of enrolled Students only and must not be copied, reproduced, shared, distributed, recorded, published or used for commercial purposes without the prior written permission of Young Actors Academy.
22.1 Young Actors Academy processes personal information in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and our Privacy Policy.
22.2 By enrolling with Young Actors Academy, Parents and Guardians acknowledge that personal information will be processed for the purposes of administering enrolment, safeguarding Students, communicating with families and delivering our Services.
22.3 Full details of how personal information is collected, stored, shared and protected are set out in our Privacy Policy, which forms part of these Terms.
23.1 Young Actors Academy shall not be liable for any delay, interruption or failure to provide the Services where such delay or failure arises from circumstances beyond our reasonable control.
23.2 Such circumstances include, but are not limited to:
a) severe weather;
b) fire or flood;
c) epidemic or pandemic;
d) government restrictions;
e) industrial action;
f) venue closure;
g) utility failure;
h) failure of third-party providers; or
i) any other event beyond our reasonable control.
23.3 Where reasonably practicable, Young Actors Academy will endeavour to provide an alternative session, an alternative venue or online delivery.
24.1 Nothing in these Terms excludes or limits liability for:
a) death or personal injury caused by negligence;
b) fraud or fraudulent misrepresentation; or
c) any other liability which cannot legally be excluded or limited under the laws of England and Wales.
24.2 Subject to Clause 24.1, Young Actors Academy shall not be liable for any indirect, consequential or economic loss arising from participation in the Services.
24.3 Our total liability in respect of any claim arising under these Terms shall, to the fullest extent permitted by law, not exceed the total Fees paid by the Parent/Guardian during the twelve (12) months immediately preceding the event giving rise to the claim.
25.1 Young Actors Academy reserves the right to suspend or terminate a Student's enrolment where:
a) these Terms have been materially breached;
b) Fees remain unpaid;
c) the behaviour of the Student, Parent/Guardian or any person connected with the Student is abusive, threatening, discriminatory or otherwise unacceptable;
d) continued participation presents a safeguarding or health and safety concern; or
e) continued participation is likely to have a significant adverse impact on the Academy, its staff or other Students.
25.2 Where enrolment is terminated under this clause, any outstanding Fees due under these Terms shall remain payable.
26.1 Young Actors Academy may amend these Terms from time to time to reflect changes in legislation, business operations or the Services we provide.
26.2 The latest version of these Terms will always be available on our website.
26.3 Where changes materially affect the rights or obligations of Parents and Guardians, reasonable notice will be given before the changes take effect.
27.1 These Terms and Conditions, together with our Privacy Policy and any enrolment information supplied by Young Actors Academy, constitute the entire agreement between Young Actors Academy and the Parent/Guardian relating to the Services.
27.2 No verbal statement, representation or assurance made by any member of staff shall vary these Terms unless confirmed in writing by Young Actors Academy.
27.3 If any provision of these Terms is found by a court to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
27.4 No failure or delay by Young Actors Academy in exercising any right under these Terms shall constitute a waiver of that right.
28.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
28.2 Any dispute arising from or relating to these Terms or the Services provided by Young Actors Academy shall be subject to the exclusive jurisdiction of the courts of England and Wales.
